Fiduciary Services

 

Fiduciary services provided by us protect employers from facing fines or penalties for failing to satisfy fiduciary responsibilities. Along with offering diverse investment options and properly managing required documentation, our 3(16) fiduciary services appoint us as a plan administrator to assume liability alongside our client. With extensive experience and in-depth knowledge of retirement planning and compliance, we confidently assumes the role of co-fiduciary.

 

3(16) Fiduciary Services Include:

  • Assume liability as an acting plan administrator
  • Maintain the tax-qualified status of the plan document to ensure the plan acts in accordance with its terms and timely adopts mandatory plan amendments
  • Determine eligibility of employees to participate in the plan and provide enrollment materials
  • Provide plan participants with required documentation, such as SPD, SMM, and notices

 

  • Maintain records in compliance with ERISA Section 3(16)
  • Review, sign, and file all required government filings for Form 5500 (if applicable, Form 8955-SSA)
  • Conduct fiduciary meetings and maintain meeting minutes
  • Authorize and approve the payment of disbursements, distributions, and withdrawals by plan participants
  • Represent the plan and oversee all communications with government agencies, including the IRS and/or Department of Labor
